for felony

Robert Dawson< no role > Headborough of the Parish of Saint Botolp
without Aldgate in the County of Middlesex maketh Oath and
saith that he was bound by Recognizance entered into before Robert
Smith
< no role > Equire one of His Majesty's Justices of the Peace in and for
the said County to appear at this present Session of Gaol Delivery
holden for the said County in order to give Evidence upon a Bill of
Indictment to be preferred against the above Defendant for felony
And this Deponent further saith that he did duly attend at the Session
House on Clerkenwell Green in ye said County and did then and
there give Evidence to the Grand Jury upon a Bill of Indictment
preferred and afterwards found a true Bill against the said Sarah
Austin
< no role > And this Deponent further saith that he hath duly attended
This Honourable Court every day since Session began in order to give
his Evidence upon the Trial of the said Indictment until Saturday
last (the 26th: Instant) when this Deponent was obliged to and did really attend
at the Session House aforesaid in pursusance of a Writ of Subpana
(which this Deponent had been served with a few days before) issuing
under the Seal ofSelby Esquire Clert: of the Peace for the
said County in order then and there to give Evidence upon [..]
the Trial of a certain Indictment found against one James Callender< no role >
and Patrick Leonard< no role > for a Misdemeaner And this Deponent further
saith thathe did a He [..] on his return to this Honorable Court from Session House aforesaid he was informed
and believes: that the Trial of the said Sarah Austin< no role > came on
during his (this Deponents) absence and that the Recognizance
of this Deponent on account of his not attending when called
[..] was ordered to be Estreated And this Deponent further saith
that the reason of his not attending this Honorable Court to give Evidence
against the aforesaid Sarah Austin< no role > upon the Trial of the said
Indictment was not from any wilful neglect, or intention to serve
