Material Witnesses for these Deponents upon this Indictment and
without whose Testimony there Deponents cannot make their Inosence
known and these Deponents also say That the said Laurence
Gardner, Thomas Dennis< no role > , Richard James< no role > Natheniel Le the and
Edward Warren< no role > have hitherto at a very considerable Expence to these
Deponents been prevailed upon to remain in England for the purpose of
giving Evidence for these Deponents and have constantly attended
for that prupose at or near the Sessions House ever since theSession
House
commencement of the present sessions, but these Deponent say
That the said Lawrence Gardner< no role > Thomas Dennis< no role > Richard James< no role > Nathaniel
Settle
< no role > and Edward Warren< no role > being now engaged as these Deponents are
informed and verily believe to said upon a voyage into Parts beyond the
seas, which voyage will commence in a few Days and before the next
Sessions, these Deponents must necessarily as they verily belive he deprived
of the Benefit of their Evidence as also of that of the said David Wylie and John
George
< no role > Considin unless the Tryal of These Deponents be appointed this present
session, these Deponents having already lost the Testimony of one Dirk
Doorm an Mate of the said Prize [..] a Material Witness for these
Deponents, the said Dirk Doorman being gone To Holland although these
Deponents had actually caused him to be subpeenald to give Evidence on
the said Tryal.
