Thomas Breese< no role > of Laurence Poultney Lane London Poulterer
Severally Make Oath and Say and first this Deponent Robert
Johnston
< no role > for himself Saith That Captain George Smyth< no role > of the
fifty Second Regiment of Foot on the Irish Establishment
is a very Material Witness for this Deponent on the above Prosecution
and without whose Testimony this Deponent cannot Safely
Proceed to Tryal thereon and this Deponent Robert Johnston< no role >
further Says that he hath caused the most diligent Search
and Enquiry to be made for the said Captain Smyth at the
Golden Cross Inn and at the Rummer Tavern at Charing
Cross where the said Captain Smyth Lodges or frequents
in Order that he might be Subpena'd to give Evidence for this
Deponent on the Tryal of this Indictment but hath not
been Able so to do by the next Session and this Deponent
Saith he is Informed by the person who made such Enquiry
that the said Captain Smyth went out of Town in a Post
Chaise on or about Monday last on a Visit into the Country
but to what part the said person could not find out but
was Informed by the person at the Golden Cross Inn that
he would return to London in about a weeks time & Dept. was since Informed he used to Bath
which Information this Deponent verily believes to be
true And this Deponent Thomas Breese< no role > for himself Saith
that by the desire of the said Defendant Robert Johnston< no role >
he this Deponent did yesterday make the most diligent
Search and Enquiry for the said Captain Smyth at the
Golden Cross Inn and at the Rummer Tavern at Charing
Cross at which places the said Captain Smyth Usually
frequents and was there Informed that the said
Captain Smith
