Maketh Oath and Saith That on or about the Twenty Second day
of July last this Deponent entered into a Recognizance before Sir John
Fielding< no role >
Knight one of his Majestys Justices of the Peace for the said County
in the penalty of Forty pounds Conditioned that Martha his Wife should
appear at the then next session of the Peace to be holden at Hicks Hall in
Saint John Street
in and for the said County and then and there [..] purper
a Bill of Indictment against one Ralph Rowland< no role >
for Feloniously Stealing
her pocket and Seven Shillings and Six pence in Silver therein Contained
the Property of this Deponent and if the said Indictment should be returned
a true Bill that then she should prosecute the Law with Effect thereon against
the said Ralph Rowland< no role >
at Justice Hall in the Old Bailey
And this Deponent
further Saith that at the Time his said Wife should have Attended to have
Preferred the said Indictement at Hicks Hall Pursuant to the Condition of
this Deponents Recognizance she lay dangerously ill of a Quinsey and sore
Throat and could not have Attended that Session without imminent danger
of losing her life, nor is she yet recovered of that illness but continues in
a very languishing and weak condition. And this Deponent further Saith
tha it was not through any wilfull neglect or Omission or through any
favour towards the said Ralph Rowland< no role >
that his said Wife did not
appear to prosecute him Pursuant to the Condition of his Deponents
Recognizance but on the Contrary his Deponent and his said Wife wish and
were desireus to have prosecuted the said Ralph Rowland< no role >
for the said Felony
if it had been in their Power so to have done.
