On the Indictmt. of Robt. Juardine< no role >
For a Supposed Defraud

Frederick Mac Cannon< no role > the said Defendant Maketh Oath and
saith That the Prosecutor having Preferred this Indictment for a
Supposed Fraud and the same being found a true Bill this Deft is
is informed that by the Custom of the Court this Deft must take
his Tryal at the Present Sessions And this Defendt. further said
that Gregory Mac Cannon< no role > and some other Persons are [..] very Material Witnesses for this Deft
on the Tryal of the saidDeftIndictment and that this Deft
cannot safely Proceed to the Tryal thereof without the Benefit of
their Testimony And this Deft further saith that the sd. Gregory
Mac Cannon< no role > is a prisoner in Custody of the Keeper of the Palace
Court Prison And by reason of the Shortness of the time this Dept. cannot
cause a Habeas Corpus to be Sued out directed to the Judges of the said
Court to bring the sd Gregory Mac Cannon< no role > into this Court so that
this Deft might have the Benefit of his Testimony And altho diligent
enquiry hath been made as this Dept is infd. & believes to find out
the places of abode of the said other Persons, Yet this Dept hath
been informed & believes they cannot be found So that this Dept
cannot have the Benefit of their Testimony On the Tryal of the said
Indictment but that this Dept shall be able to find them out so
as to have the same against the next Sessions Andthatthis Dept
further Saith he is informed & verily bels. he hath a just and
good Defence to make to this Indictment And that upon the
Tryal thereof he shall be Acquitted of he has time given him to
prepare his Defence thereto
