The King at the Prosecution of Cornelius York< no role > Plt

The said Prosecutor maketh Oath that on the 28th. of Sept. last he this
Depont. was without any Just Provocation most Violently Assaulted Beaten
Ballered & abused by the sd. Defendant insomuch that he shed this
Blood and this Dept. says That he did not resist nor Strike the said Deft.
& that for the said abuse he this Dept. in Octor. last preferred a Bill of
Indictmt . against the said Deft. at the Quarter Sessions held for the Liberty
of Westmr.which was then found to be a good Bill But
the said Donnelly to Evade the Justice of the Law (to which this Dept.
is Intitled as he humbly apprehends & verily Believes) has made
& caused to be made Severall affidavits from time to time of People's
being beyond the Sea & elsewhere who he pretends were Present at the
Time of the said Assault given to this Depont. by the said Defendt. & this
Dept. Further Says that on an Application to this Honble Court last
Sessions the Court then Selling Refused to put off the Tryall of the
said Deft. But on the said Defend or his Council's Agreeing to brings
on the said Tryal this Sessions and also agreeing to pay the Costs
of the Day and this Depont. Says that the said Deft. has by all
ways and Means in his Power (as this Depont. verily Believes
Ruined & Endeavoured to Ruin this Depont. & his Family and hs
been as Letigious & Vexatious to this Dept. as he Possibly could
& put this Dept. to great Costs & Expences And this Dept verily
Believes that the said Dept. will never come to Tryal in this Cause
if he can help it, and this Dept. likewise verily Believes that the
said Defendt. will from time to Time make affidavits of this
Witnesses being out of the way to Wade Standing Tryall in
this Cause & to Impose upon this Honble Court
