are both material Witnesses for this Depont on the Tryal of the Indictmt in this
Cause and that he Cannot Safely Proceed to such Tryal witht the benefit of their
Testimony by reason of their being both present at the time When the said pretended
Assaulte is Supposed to be Committed and lastly this Depont Saith that it hath
not at any time been in this Deponts Power by any means to procure the sd
John Brasell< no role > or Ralph Fuller< no role > to attend at the Tryal of the said Indictmt
but this Dept verily believes ye both of them will attend at the next
Session of the peace for the said City and Liberty and Give Evidence for
this Depont on the said Tryal
