Wapping in the County of Middlesex Mariner
one of the Defendants in the above Prosecution
Maketh Oath and South that he was Indicted in
July Session last with the other Defendants for an
Assault that not Knowing the Place of Abode
of the Prosecutor he can let not give him Notice
of Tryal for the their Next Session but moves the
Court in October Session to respite theReign [..]
And this Deponent further south that he this
Deponent as well as the other Defendants hath
made Diligent Inquiry but Cannot find either
the Prosecutor or his Place of Abode to Serve him
with Notice of Tryal And therefore humbly hopes
that this Honorable Court will Respite the
Recognizances and Make an Order that Notice
of Tryal being Stuck up in the Hale or Office
or left at the last place where he was known may be
Deemed and taken as Notice of Tryal for the Next
Ensuring Session
