{The King against Isabella Collier< no role > on the
Prosecution of James Cook< no role > for Perjury

Middlesex (to wit)


William Coombe< no role > of Sampsons Gardens in the Parish of Saint
George in the East in the County of Middlesex Gentleman Solicitor for the Defendant
in this Prosecution Maketh Oath and Saith that he this Deponent did on Wednesday
last being the seventh day of this Instant February go to the Royal Exchange Lloyds Coffee
House and to the Custom House in London in Order to serve James Cook< no role > the Prosecution
in this Cause with a true Copy of the Notice hereto annexed at which Places this Deponent
was informed and which information this Deponent believes to be true he could meet with the
said James Cook< no role > in order to serve him as aforesaid and this Deponent further saith that
not being able to meet with the Said James Cook< no role > at either of the above Places he did on
the Evening of the same day go to the House of Mrs. Noble (who is the Daughter of the
above Named Prosecutor James Cook< no role > ) situate in Sampsons Gardens aforesaid at whose
House the said James Cook< no role > Lodges and resides for the Purpose of serving the said James
Cook
< no role > with the said Copy but was informed the said James Cook< no role > was not at Home And
this Deponent further saith that he this Deponent did at the same Time and place
aforesaid Personally serve the said Mistress Noble with a true Copy of the Notice hereto
annexed and that she the said Mistress Noble faithfully promised this Deponent that
she would deliver the same to the said James Cook< no role > as soon as he came in and this
Deponent further saith that he did on the Friday following go again to the said Mistress
Noble at her House situate as aforesaid and did enquire of her if she had delivered
the said Notice so given and left by this Deponent to the said James Cook< no role > when the
said Mistress Noble refused to make any answer to this Deponent whether she had or had
not delivered the said Notice to the said James Cook< no role > and this Deponent further
saith that he did on Saturday last Casually meet the said James Cook< no role > in Globe
Street Wapping when this Deponent enquired of the said James Cook< no role > if he had
received from his said Daughter the said Mistress Noble the Notice which had been left
by this Deponent to her as aforesaid when the said James Cook< no role > informed this Deponent
that he had received no Notice whatsoever from his Daughter nor had he any knowledge
whatever of any Notice being left for him but that he had given Orders and directions
to Mr. Mawley his Solicitor to remove this Prosecution by a Writ of Certiorai into a
superior Court and this Deponent further Saith the above named Defendant was
ready and willing to take her Trial upon the said Indictment it the Prosecutor
would consent thereto and so this Deponent informed the said James Cook< no role > and
Mr. Mawley his Solicitor but which they refused so to do
