Shall be binding and conclusive upon the sd. James Tyson< no role > to be insufficiently or improperly Executed
on Point of form or Workmanship or with Materials that Shall be unfit or improper their and in
Such Case upon notice from Such Surveyor the sd James Tyson< no role > Shall & will forthwith Cause the sd
work to be Pulled or taken down & Performed and Executed again in a good Sufficient and &
Substantial manner according to the true instant and meaning of these Presents and on default
of his Pulling and taking down and removing & reexecuting the Same in Manner aforesaid it
Shall & may be lawful to and for the Surveyor for the to me being to the Said Comrs to Cause the Same
and also all Such Work as Shall be Erected thereupon or Connected therewith or the removal
whereof Shall be necessary for the Purpose of Reexecuting the work so insufficiently or &
Improperly done to le Pulled or taken down & removed aforesaid and to be Performed
and Executed again in a Substantial and workmanlike manner at the Costs and Charger
of him the Said James Tyson< no role > which Costs which Costs and Charges it Shall & may be lawful
45to & for the sd Comrs to deduct & Retain out of the Payments herein after Covenanted
to be made to him the sd James Tyson< no role > And in Case by Pulling or taking down
Such improper & insufficiently Work as aforesaid & Performing & Executing the Same
again in a Substantial & Workmanlike manner any other workman or Pur [..]
who Shall be Employed in or about the sd building Shall be untarded or delayed in the
Execution of their respective works or their respective work Shall be there by injured or damged
