Thomas Hurry< no role > of Wapping in the County of Middlesex Mariner and
David Outerline< no role > of the same place Marriner Severally Make Oath and say
And first the said Thomas Hurry< no role > Speaking for himself saith That he this
Deponent and the said David Outerline were bound in Recognizances to Prosecute
Peter Hennady at the General Sessions of the Peace held for the County of
Middlesex April last for Stealing a piece of Beef of the Value of Ten pence
but this Deponent saith That when the said Peter Kennady< no role > was Carried before
one of his Majesty's Justices of the Peace for the County of Middlesex Al though
the said Justice did as near as this Deponent Can Remember Talk of Bindings
him ever to prosecute the said Peter Kennady Yet as this Deponent did not
Sing any Paper or Writing and as the Justice Seemed to make light of the
Affair this Deponent did not Know nor did he in the Least Apprehend or
Believe that he was bound in any Recognizance to Prosecute the said Peter
Kennady And this Deponent further saith thatin a few days after he
entered into the said Recognizance he went on a Voyage to sea and this
Deponent Verily believes he was out on a Voyage atthe time the Sessions Came
on when the said Peter Kennedy< no role > was to have been tried And the said David
Outer line Speaking for himself saith that he did not Know or in the Least
Apprehend or believe that he was bound in any Recognizance to Prosecute the
said Peter Kennedy< no role > as the Justice before whom the said Peter Kennedy< no role > was
Carried Seemed to Make light of the Appair and this Deponent did not sing
any Paper or Writing for that Purpose And this Deponent further saith
That in thir a few days after he Entered into [..] a Recognizance he went on a
Voyage to sea And Verily believes he was out on a Voyage at the time Sessions Came
an when the said Peter Kennedy< no role > was to have been hied this Deponent at that
time being Mate of the Ship of which the said Thomas Hurry< no role > was Master And
the said Thomas Hurry< no role > and Peter Outer< no role > line further upon thir Oath say That
it was not through any Willfull Neglect as partiality that they did not Proper
a Bill of Indictment against the said Peter Kennady.
