The King against Richard Reilly< no role > John Mc Ferlon< no role > and
Joseph Williams< no role > for a Conspiracy

Patrick Duffy< no role > Administrator of Edmond Reilly< no role > lately dressed the Prosecutor in
this Cause maketh Oath that Elizabeth Gibson< no role > the Wife of Mr Gibson of Holland House in
Holland Street in the Parish of St. Ann with in the Liberty of Westminster is a material Witness
for this Deponent on the Tryal of the Indictment in this Cause and without the Benefit of whose
Testimony this Deponent cannot with safety proceed to the Tryal of this Indictment
And this Dependant further Saith that he this Deponent did on Tuesday the Twelth Day of
this Instant September after he had received Notice from the Defendant John Mc Ferlon that he intended
to plead not Guilty and take his Tryal on the Indictment in this Cause go to the House or Lodgings
of the said Elizabeth Gibson< no role > in Holland Street aforesaid to know if she was in Town in Order that he
might precure her to be Served with a Subpena to Compell her to give Evidence against the said Several
Defendants at the Tryal of the said Indictment at this Present Session Whereupon such Inquiry he was
informed by the said Mr Gibson that the said Elizabeth Gibson< no role > his Wife was at Timbridge Well
in kent selling her Millrary Goods And that her Return to London was not expected untill the latter
End of this present Month and which Information this Deponent Verily beleives to be true And this
Deponent further Saith he will use his atmost Endeavours to procure the said Elizabeth Gibson< no role > to
attend and give Evidence against the said Defendant at the next October Session which this Deponent
doubts not but he shall be able to do And this Deponent further Saith the Indictment in the Cause
having been found in May Session now last part the said Defendant Mc Ferlan procured a Wit of
Certiorari to be allowed to remove this Cause into the Court of Kings Brick Which this Deponent at
some Expence sevt back by procedendo in Timity Term last And this Deponent Saith that if the
Said Defendant Me Ferlan hed not procured Such Wit of Certiorari to be brought and allowed as
aforesaid and that the said Defendant Richard Reilly had not by Surprize been discharged at the
Old Bailey in May Session last after having been removed from Wood Street Compter where he was
Comitted by Mr. Alderman Cockayne and Could not be retaken till very lately this Deponent might
have been able with safety to have proceeded to the Tryal of this Indictment at the last Jane Sessions
the said Elizabeth Gibson< no role > and this Deponent other Witnesses being then in Town
