. And this Deponent saith, that
at that times He this Depont. had the Copping, of some of
the Books, belonging to Col: Cockrans late Reginit. of
Marines, And that the said Oliver MacAllister< no role >
, used
frequently to come into the Office, where this Depont.
was, and to look into the said Books, and having found
this Name of one James Rathery< no role >
who Died on Board
the Vigilant Man of War, in the East Indico
in the
year 1748 as this Depont. verily beleives, He some time
after, sent for this Deponent, to his House in Queen
Street
aforesaid, where he then Lived, and Desired him
to fill up a Blank Will, in the Name of the said James
Rathery, and promised to pay this Deponent for ye same.
And this Depont. at that time, not imagineing [..]
any harm in the Act, Did at his Request fill up the
said Will (being a Printed one) from a Draft of
Insertions which the said Oliver MacAllister had
drawn up, in his own Hand Writing. And this Dept.
says, that the said Will, was dated in 1744. and that
one George, Rathery, was named as the Couzin to the
said Festor, and sole Executor therein, And this Depont.
saith that after the said Will was so filled up, the
said Oliver Mac Allister put a Seal thereto with
Wax, and broke of part of the same, and them made a
Mark as therein is made, as and for, the Mark of the
said Festor, and them made this Depont. Write over
or about the same (the Mark of James Rathery) as
this Depont. best Remembers, or to that Effect.
