day of this Instant October serve Timothy Kelles< no role > the Prosecutor
in this Cause with a true Copy of the Notice of Motion hereunto
annexed by delivereing such true Copy to the said Timothy Kellys< no role >
Son [..] at the said Timothy Kellys< no role > house in St. Johns
Street and this Dept. further saith that there is an Indictment
subsisting against the said Timothy Kelly< no role > preferred by the
said Letitia Curtis< no role > for the same Offence in Point of Time and this
Depont. further saith that he has used his almost Endeavours
to get the said Timothy Kelly< no role > brought into Court by the
Warrant her unto annexed but was never able to precure
it to be Executed
