the Prosecuts. maketh Oath that the Deft Robert Crane having
preferred an Indictment against the Depont. for an Assault
and thereupon obtained the Lord Cheife Justices Parken
Warrant Caused this Depont. to be taken therwith on ye 2d
of November last and hurryed this Depont. to the Poultry
Counter in which place he was Charged with two severall
Actions at the other Defth Allan & Wynn< no role > s Suite and this
Depont. is now a presoner in the Flat prison at the Suite
of the Sd Wynn & Allen And this Depont. farther saith
that his Wife being a Materiall Evidence to prove the
Indictmt. preferred Against the Sd. Defts is now Sick
at this Deponts house at Greenlake aforesaid and can't
without great danger of her life as this Depont is
informed and beleives comes to Lord on wherefore this
Depont. Saile that he cannot Safely proceed to try all
upon the Sd Indictment without her testimony And
this Depont Saile he did not receive ye Copy of the Ordr.
hereunto Annexed untill latelaston Wensday night last
