Anne chapter 23 This Rate is to be collected by the Constables
or Such other persons as the Session Shall appoint and paid
over to the high Constable of the Several Divisions quarterly who
are twice a yeare to account to the Treasurers, But there is no
penaltys on Collectors or high Constables for any default in
not collecting accounting or paying over the Said moneys in
their hands, And that the Committee conceive they are Indictable
and no other way punishable unless the Collectors shall be
Judged to be within the penalty of fourty Shillings laid on
Collectors of Bridge Rates by the Act of 1st. Ann chapter 18
Sect 3 to which this Act relates in this clause where the
Sessions are impowered to raise money for this use by Such ways as
they may by law for repairing County Bridges, But there
appeares to the Committee to be Several defects in this Act,
there being no power given to levy the penaltys by distress or
otherwise, So no remedy but by Information or Judgment, All
which the Said Committee certify and Submit to the Judgment
of this Court, This Court upon reading the Said Report Doth
agree thereunto, And doth Order that an Indictment or
Indictments be preferred against the petty Constables of the
parishes of Acton & Ealing in this County for not assessing
raiseing collecting & levying the moneys assessed by the Said
Rate upon the Said parishes respectively as their Quota or
proportion of the moneys directed and intended to be raised
by vertue of the aforesaid Rate to defray the expences of
passing & releiving of Vagrants and also against other
parishes who are in arreare upon the Said Rate, And that
Such Indictment or Indictments be effectually prosecuted in
order to recover the Said arreares But the Committee of his
Maties Justices of the peace of this County (appointed by
Order of Court to take the accounts of the Treasurers of
this County) are hereby authorized first to Summon
before them if they Shall think proper the Officers of
Such parishes before them who are Soe in arreare before
any Such Indictment or Indictments be preferred And
this Court doth further Order that the expences of the Said
prosecutions Shall be born & paid out of the moneys
raised by vertue of the aforesaid Rate.

Whereas Henry Barker< no role > Esqr . one of his Maties Justices of the
peace of this County and Treasurer of the Bridge money was
by an Order made at the last General Sessions of the peace
holden for this County by adjornment on Thursday the fifth
day of December last directed to produce before this Court on
the first day of this present Quarter Sessions (to witt)
