Answer 1

As to the fit Assertion in this Paragraph his true and it is by
usage time out of mind that the Goal Delivery of Newgate is held
for the County of Middx aswell as for the City of London at
the Old Baily a place in the City. As to the Number of
Malefactors they are generally more in Middx than in London
tho' some times otherwise But the Court is obliged to discharge
the Goal let the Number be what it will and have thereby
only the more trouble and the City the more Expence

That the Clerk of the peace of the sd. County or his Deputy &
the Under Sheriff & his Officers Do always attend at the Sessions
of Goal Delivery and have places assigned them for that purpose

Answer 2

It is the Duty of those Officers to attend there, And the City (who
are owners of the Court & the House at the Old Baily and who
constantly repair it and make alteracons from time to time at
they think fit and with whom this Comission has been
Entrusted time out of mind (Joyned with the Judges Etc) Have
always made accomodacons for every one whose business may
call them thither, and they find room accordingly But for any
such Officers to demand a Right in any particular place is what
they have not presumed And cannot pretend to, and if the Court
should assign them any other place than what they usually Sitt
in'tis their duty to submitt to it, tho' they may not think it soe
convenient.

That the Justices of the peace of the said County are obliged to
attend the Sessions with the severall Examinacons & Confessions
by them taken and have constantly had the East side of the said
Court reserved for them, But of late that place hath been lst
out to hire or otherwise disposed of by the officers of the Court
And the Justices thereby and by other methods of late Years use
have been made uneasy & are very much discouraged in the
discharge of that part of their duty, which they have been
and shall be always ready & willing to perform

Answer 3

That'tis the Duty of the Justices of the peace to attend the said
Court with the Examinacons and Confessions by them taken is
time, And the Acts of Parliament for the Sake of Justice
require it of them, That the Justices have usually come on
the Bench on the East side of the Court And that that place
has been usually (if not constantly) reserved for them is as
time; But that the Officers of the Court have of late presumed
