having unlawfully defrauded this Deponent and his Partners
of a Piece of Irish Linen and a piece of Muslin And this Deponent

is as this Deponent is informed and believes a material Witness

testimony this Deponent cannot proceed to Prefer a Bill of Indictment

return and attend at the next Session and give Evidence against
