of this City bound in a Certain
Recognizance of ten Pounds upon Condition that this Deponent
Should Give his Testimony as Evidence on behalf of our Sovereign
Lord the King on the Porcecution of Sunderland Agt. Thos. Doyle< no role >
for Stealing a Silk handkercheif the Property of the Sd. Sunderland
And that inConformity to the Sd. Obligation this Deponent
And Attend with the Above named Procecutor and did On
friday the 13th day of Janry. Inst Present a bill unto the Grand Jury
Concerning the Sd. Offence Agt. the Sd Thos Doyle wich Sd Grand
Jury did Return as a True bill That this Depont. withthe
the Procecutor did wait in the Passage leading into the
Court with an Intent if Called on to Give his Evidence for the
Procecutor agt. the Sd Doyle And that he Understanding
The sd Doyle would not Come on Untill Saturday Morn. [..]
Upon wich this Depont. Departed the Court and went
Home to Provide Nessessary Assistance for his wife and family wich
was all Sick Not in the Least meaning or Intending
Any Contempt to the honourable Court then Sitting
but being Called Upon by the sd Honble Court on the Same day
the bill was found to Come into Court and Give Evidence
Agt. the Sd. Doyle Did Neglect but not willfully Such
Attendance and Thereby as this Depont. Understands hath
Incurred the for fitture of his Sd. Recognizance through his
Non Attendance And further this Depont. saith that
the Acquittance or discharge of the Sd. Tho [..] Doyle
but Through Ignorant Neglect And Lastly
This Dept. Sayeth that he hath at this Time a
wife and four Children three of wich be afflicated with Illness
