The King Agt. William Goodall< no role >
upon an Indictment for perjury at the
prosecution of Samuel Knott< no role >

William Goodall< no role > of the parish of Christ church in the County
of Surry Gentleman the said Defendant and William Cuthbett< no role > [..] of
London Gentleman Severally make Oath And first the said William
Goodall for himself Saith That he was Indicted by Samuel Knott< no role > in
last September Session for perjury with respect to the payment of
Two Guineas And this Depont. Saith that at the Sessions of Oyer
and Terminer [..] holden at Justice Hall in the Old
Bailey in and for the City of London and October last he Traversed
and pleaded to the said Indictment And this Depont. further
Saith That he should have tryed his Traverse on the aforesaid
Indictment at the last Sessions of Oyer & Terminer but the Court
was then pleased to put the Tryall of the said Indictment off
on Account and by reason of one John Day< no role > a material Witness
for this Depont. being at Lisbon in the Kingdom of Portugal
And this Deponent Saith That on the tenth day of this Instant
January he caused a Notice in Writing to be delivered to she sd.
Prosecutor purporting that he would appear at this present
session of Oyer and Terminer and then try his Traverse on
this said Indictment (which was Six days Notice) in full
Expectation that the said John Day< no role > would have arrived and
came to London with the last Feel that came with Convey
from Lisbon in the Kingdom of Portugal And this Depont.
further Saith That since the saint Notice so given as aforesaid
he went to the said Mr. John Days Wife (who lives in Snows
Fields in the said County of Surry) to enquire of the said Mr.
Day was arrived with the last Fleet that came from Lisborn
And she Informed this Depont. That her Husband Mr. John
Day was Chief Mate of the Good Ship or Vesell called the
On slow Whereof Robert Ram< no role > is Master in the Mercantile
Service and that the said Ship was at Lisbon And this Depont.
Saith That the said Mrs. Day also Informed him that she had
received a Letter from her said Husband by the last Fleet
that came from Lisborn in the Kingdom of Portugal Wherein he Acquainted her that he should have come home with
the said Fleet but was disappointed with the Ships Ladeing and
that they waited for Frist and that it would be full three months
