Woodmonger the Prosecutor in this Cause maketh
Oath That William Preston< no role > master of a Coalstys
is a material Witness for this Dept: in this
Cause and this Dept: saith that he hath made
enquiry at Billingsgate & among the masters of
ships & other dealers in Coals for the sd William,
Preston & he is Credibly informed that the sd Wm
Preston is now at or near Sneton near Whitby
in Yorkshire by reason of the distance whereof
from hence being near two hundred miles he cannot have the sd Mr Preston
up to give Evidence on the tryal of this Cause
and the Dept: further saith that he cannot
safely proceed to the tryal of this Cause wth out
the benefit of the testimony of the sd Wm Preston< no role >
as this Dept: is advised & verily believes
