The King upon the Prosecution of
Messrs. Scotts
against
Samuel Burland< no role >

Samuel Burland< no role > of Tabenacle Walk in the Parish of Saint
Luke in the County of Middlesex Chandler Maketh Oath and saith that
[..] Some Time before last September Sessions George Hargrove< no role > and Thomas Jones< no role > did Enter into a Recognizance
before David Wilmot< no role > Esqr. one of his Majestys Justices of the Peace in
and for the County of Middlesex that he this Deponent should appear and take his Trial at the said
next Sessions for having received One Hundred and fifty Bricks the Property
of the said Messrs. Scotts Knowing them to be Stolen And this Deponent
Saith that he did Attend at Justice Hall in the Old Bailey the four first
Days of the said Next Sessions agreeable to his said Recognizance for the purpose
of Surrendring himself and Taking his Trial upon the Indictment do Preferred
against him by the said Messrs. Scotts at the same time with Richard Baldwin< no role >
who was also Indicted for Stealing the said Bricks but the said Trial did not
come on And this Deponent also Saith that he did Attend on the fifth Day
of the said Sessions for the same purpose from Nine of the Clock in the Morning
untill Eight of the Clock in the Evening of the same Day when this Deponent and
his Witnesses were informed by Several persons that the Trial of the said Richard
Baldwin
< no role > and this Deponent would not come on till the Next Morning upon which
this Deponents Witnesses one of whome was very ill refused to Stay any Longer
looking upon it as unnecessary and therefore they and this Deponent went Home
first agreeing to be at the Sessions House by Nine of the Clock of the Next
Morning and this Deponent further Saith that he did Attend with his Witnesses
by Nine of the Clock of the said Next Morning at the said Sessions House for the
Purpose of Surrendring himself up and Taking his Trial on the said Indictment
when to his great Surprize he was informed that the said Richard Baldwin< no role > had
been Tried the preceding Evening and that his this Deponents said Recognizances
was Ordered to be estreated and that if he then Surrendred himself he Could not
be Tried on Account of the Witnesses for the Prosecution not being there to
give Evidence against him And this Deponent also saith that his not Surrending
himself and taking his Trial at the said last Sessions at the same time with
the said Richard Baldwin< no role > did not arise from any Desire to delay or escape
being tried nor from any Contempt of this Honourable Court but was Solely
Occasioned by the Circumstances herein before stated And this Deponent lastly
saith that he hath been tried at this present Sessions upon the said Indictment
and acquitted.
