Deponent that they had been tried about one of
the Clock in the Afternoon of the same Day and were
discharged through Want of Evidence And this
Deponent further saith that he wished and was
desirous of giving Evidence against the said Prisoners
but that not being acquainted with the proper Place
for him to wait at till he was called to give Evidence
he never heard himself called and that his not giving
Evidence against the said Prisoners arose not from
any Contempt of this Honorable Court or Favor to the
said Prisoners but was solely occasioned by his not
hearing his Name Called when they were put upon
their Trials And this Deponent further saith that
if he had been examined on the said Trials he could
only have proved that he missed Oil but could out
have proved his Property therein
