John Heitman of the Parish of St. John Wapping in the County of Middx Victualler and Susanna
Payne
< no role > of the same place Wido. Maketh Oath & Say that on or abot. the 30th. day of Octr. last (1772) these
Depots. were bound by a Recoginzance in the Panal Sum of £40 each upon Condition that this Dept. John
Heitman shod. prefer a Bill of Indictmt. at Hick's Hall in St. John Street in the sd. County & the other Dept.
Susanna Payne< no role > to give Evidence there or agt. John Branson< no role > for feloniously taking & carrying away a
Shirt the property of the sd. Dept. John Heitman and if the same shod. be return'd a true Bill then these Depts.
to appear and give Evidence thereon at the then next Sess. of Goal Delivery of Newgate to be holden for the said
County of Middx And these Depts. Say that on or abt. the 7th. day of Decr. last past these Depts. attendd, at
Hick's Hall aford. when a true Bill was found against the sd. John Branson< no role > for the sd. offence and these Depts.
continued to attend there (necessary time for refreshment only excepted till the evening of Friday the Eleventh
day of Decr. last when there Depts. were ordered by some or one of the Officers belonging to Hick's hall
to Attend [..] at the Old Bailey And these Depts. fnr. say that they [..]

immediately attended at the old Bailey and continued to attend there the whole of that evening and above
the whole of the next day in order to give Evidence against the said John Branson< no role > for the said Offence (necessary
time for refreshment excepted) And these Depts. fud. Say yt. they attendd. at the Old Bailey on Mondy.) the 14th.
day of Decr. last till abot. 4 old in the afternoon when the went to Bagnis Court in Newgate Street in order to
Refresh themselves & these Depts. Say that they did in less than half an hour pan their leavg. the Old Bailey
as afosd. return there to for the [..] their giving Evidence as aforsd. & immediately upon such return app [..]
to the Door keepers & informed that of their being in readiness agt. the sd. John Branson< no role > when [..]
were informed by some or one of [..] keepers or other Officers belonging to the Old Bailey that the sd. John
Branson
< no role > had just before been arranged and discharged for want of Evidence absolutely refused to
admit these Depts. into Court And these Depts. fur. [..] say they attended at the day times & places
aforesd. for the so he purpose of giving Evidence agt. the sd. John Branson< no role > for the sd. Offence & that they were [..]
at the time aforsd. for the purpose of taking necessary refreshment & for no other intent or purpose what fur.
And that they nor neither of then [..] or die apprehend that the said John Branson< no role > would in here
absence have been Arraigned or discharged as aforsd.
