Horse which Defendant again sayd he would have nothing
to do except paying for the hire it was agreed Defendant
Lavell should pay into the hands of Deponent Five Guineas
for the prosecutors use and which Deponent was to pay to
his solicitors and that Lavell should satisfy the owner of
the Horse for the hire and that no evidence was to be given
against heir or this prosecution and that the Recognizances
satered into by him should be discharged And Deponent
Further saith that ofter these Terms were agreed upon and
concluded the Prosecutor and his Solicitor Left the Court
and did not appear to give Evidence and this Deponent
Charles Lavell< no role > for himself saith that such application was
made to him by said Mr. Cope as slated by the other
Deponent Charles Bower and that such agreement was
concluded or and that said prosecutor and his Solicitor left
the Court and id appear to give Evidence against him
and this, Deponent Thorn [..] Hemsley went in Armp [..]
and Deponent saith that he then [..]
Lowe into the hands of said Deponent Bre [..] the
sum of
Five Guineas and [..] day Thursday waited
with the other Deponent Lavell the owner of the Horse one smith in order to have paid
the hire in compliance with his promise but said
Smith was not at home but which said Rasell inthat Deponent is at
any. time ready as this Depoent very believes to do and these Deponts Charles Bower
Charles Lavell< no role > and Thomas Hardley< no role > positively or their
Oath say that it was agreed upon Defendants paying
into the hands of Deponent Bower Five Guineas for
the use of the prosecutor and satisfying the owner of
the Horse for the Nine days hire that the prosecutor
would give no evidence against Defendant under this
prosecution but that he should be acquitted for warst
of Evidence and the Recognizance entered into by him
under this Prosecution descharged
