so much worne away that it is an great danger of
being Broke downed but that for secureing the Lands
from being Over flowed he had made an Insett or Counter
Wall at some distance within the sd Wall leaving abt
Ten: or 12 Acres between the Old Wall & the New One,
which will be Over flowed when the Old wall breaks
and (as they apprehend) will thereby become Unprofitable
& so be Lost to the Hospll: And they find, that the
sd Henry Collyer< no role > hath not yet planted the Orchard
or the 100: Trees of Oake Ash or Elme which he was
Obliged to plant within the first Two yeares.

Which Report was taken into Consideracon And the
sd Mr: Collyer being Sumoned to Attend this Comittee
was Called in, and he Acknowledged the Cutting of the
Oakes without Lycence from the Governors: or Accquainting
any of them therewith, and his son being here with
him, acknowledged the Felling of the Elmes, and they
say the Elmes which were blowne downe by the Slorme,
were Taken by their Tennt. & Converted to his own use
without their Knowledge; They Say that what they
did herein was through Inadvertency, and that they
did not rightly under stand the Covent: of the Lease
by which they are obliged not to Cutt any Timber
but by the Assignemt of the Governors: They say
the New Wall was absolutely necessary for preserving
the Land, and that the Old Wall having no Foreland
to it, and there being a great depth of Water and
a Whirl poole, neare the Foot of the Old Wall the same
[..] is contiunally is danger, and
that the Ground lyeing between the Two Walls will
yeild as much profitt by Reeds as it now does for
Graceing. Where upon this Comittee having well
Considered the Case, Declared their Opinion to be
That the sd Mr: Colliershallought to make
Satisfcacon to the Hospll: for the Wast by him
Comitted in Felling the sd Trees and he was
