field and of Deponents intention to
apply to quash the said Prosecutors Indictment
unless he the said Prosecutor did reply to
the said plea of Misnomer at the said
April Session and this Deponent further
faith thatserveShortly after such proceedings
were had he this Deponent being very much
reduced in his Circumstances and on Account
of his Extreme poverty was under the necessity
of absconding from his Residence and has
not since been able to make the necessary
application to quash the said Indictment.
And Deponent further Saith That the said
Prosecutor not having replied to the said
Plea of Mimomer he this Deponent is
advised that he is therefore intitled & to have
the said Prosecutors Indictment quashed in
order to prevent the Recognizance intered &
into by Deponent as aforesaid from being
estrated
