Prosecutor declared for some defamatory Words spoke by
this Deponent at the time of his committing the Assault
And this Deponent being advised by Counsel to let Judgment
go by default as Writ of Enquiry of Damages was executed
which the Jury assessed at Ten Guineas And the Costs
thereon were taxed at Thirteen Pounds & ten Shillings
making together Twenty four Pounds which this Deponents
has been sence arrested for And this Deponent further
saith that Yesterday being the 23d. instant he was
served with a Copy of a Wait of Capias at the Suit of
the Prosecutor And the ground thereof can only arise
from what passed at the time of the above mentioned
Assault And this Deponent Andrew Me Ardell for
himself saith that he did [..] upon the 22d. day
of this instant serve the Prosecutor with a Notice in
Reciting purporting that the Defendant would upon
this day personally appear in this Court to receive
Judgment upon his Confession to the Indictment And
that he would move the Court that the Recognizances entered
into by him and his Sureties might be discharged By
delivering to andleaving the said Notice at the House
where the Prosector lives with the Landlady thereof
who told this Deponent that he was not at home but
She would take Care to give him the said Notice
