in the County of Middx Coffee man (Maketh Oath)
That he this Depont. being bound by Recognizance
to Try his Traverse at this Prsent Sessions on an Indictmt. preferred
against him for a trespass & misdemeanour
saith that David Peters< no role > is a very material
Witness for this Depont. without the benefit
of whose Testimony this Depont. cannot safely
proceed to try the sd Indictmt. And this Depont.
further saith That he hath endeavored by
himself & Freinds with the utmost diligence
he can to find out & produce the sd. Peters
to give evidence on the sd Tryal on this Deponts
behalf and hath not been able to find out the
said Peters But this Depont. verily beleives
he shall be able to find out & procure the sd
Peters to give evidence on this Deponts. behalf
at the next ensueing Sessions.
