Order touching
the Respiting
of Forfeited
Recognizances}

Whereas by reason of the great concourse of his Majestyes
Subjects resorting and applying to this Court to take the
Oathes in pursuance of the late Act of Parliament made
in the Ninth Year of his now Majestys Reign in Order to
prevent their reall Estates from being forfeited severall
Persons Indicted for Misdemeanours and Bound by
Recognizanes to try their Traverses upon such Indictmts:
at this present Sessions have been Obstructed and hindred
from trying the same, And others (who have Forfeited their
Recognizances in not appearing at the Sessions of the Peace
for this County to answer for the Offences for which they
were by such Recognizances bound to appear at such
Sessions) have been prevented from applying to this
Court to obtaine A Respite of such Forfeited
Recognizances as hath been usually done in an
October Sessions to prevent the same from being
Extracted into his Majestyes Court of Exchequer , It
is thought fit and Ordered by this Court that the
Recognizances taken for the Appearance of any Persons
Indicted for Misdemeanours to try their Traverses
at this present Sessions upon such Indictments
shall be respitted untill the next Generall Sessions
of the Peace to be holden for this County, And that the
Recognizances taken for the Appearance of any Persons
at any former Sessions to try their Traverses upon
Indictments against them and of others to appear and
Answer there for any Misdemeanour or
Misdemeanours for which they also stand Indicted
shall upon Application to the Clerk of the Peace of
this County or his Deputy be respitted untill the next
Generall Sessions of the Peace to be held for this
County, And that the Forfeited Recognizances of
any Person or Persons who were thereby bound
to appeare and answer at the Sessions for any
Misdemeanour or Misdemeanours for which they
are not Indicted shall upon such Application be
respitted untill the Court shall further Order to
the Contrary.
