Attorney's and the Sheriff have not sent back the said Writ
nor have they done any thing thereupon Therefore as before let a
Jury thereupon cone before our Lord the King at Westminster on
Friday next after Eight days of Saint Hilary by whom Etc. and
who neither Etc. to recognize Etc. because as well Etc. The same day
is given to the said Parties there Etc. Afterwards the Proceedings
are continued between the Parties aforesaid of the Plea aforesaid by
respecting the Jury between them before our Lord the King at
Westminster until Wednesday next after fifteen days from the
day of Easter Unless the Kings Right Trustly and well beloved William
Earl of Mansfield his Majestys Chief Justice Assigned to hold
Pleas before the King himself shall first come on Saturday the
fourteenth day of February at the Guildhall in the City of London
according to the form of the Statute in such Case made and provided
for default of the Jurors because now of them did appear At which
day before our Lord the King at Westminster the said William comes
by his Attorney aforesaid and the Chief Justice before whom Etc sent
here his Record had before him in these words Afterwards that is
to say on the Day and at the Place within Contained before William
Earl of Mansfield the Chief Justice within named John Way< no role >
Gentleman being associated unto the said Chief Justice by force of
the Statute in that Case made and provided the within William
came by his Attorney within contained and the within named Matthew
and Stephen although Solemnly called came not but made default
therefore let the Jurors of the Jury within mentioned be taken against them be default
and the Jurors of that Jury being summoned come who to say the
Truth of the within Contents being chosen Tried and Sworn Say upon
their Oaths that the said Matthew is Guilty of the Trespass within
written as the said William within Complains against him and
they Assess the said William his Damages by occasion thereof over
and above his Costs and Charges by him about his Suit in this
behalf expended to One Pound and One Shilling and for those Costs to
forty Shillings And the said Jury further upon their Oaths says
that the said Stephen is not Guilty of that Trespass as the said Stephen
by Pleading for himself hath alledged But because the Court of our
said Lord the King now here is not yet advised what Kidgmour
to give of and upon the said Premises a day is therefore given to the
said Parties before our Lord the King at Westminster until Friday
next after the Morrow of the Holy Trinity to hear Judgement thereupon
for that the Court of our said Lord the King of now held is not yet advised
thereof Etc. At which day before our said extra the King at Westminster
the said Parties come by their Attorneys aforesaid Whereupon
