and Ward aforesaid casually lost the said Goods and Chattles out
of his hands and Possession which said Goods and Chattles afterwards
to wit on the same day and Year aforesaid at London aforesaid
in the Parish and Ward aforesaid came to the Hands and Possession
of the said Matthew and Stephen by finding the same Yet the said
Matthew and Stephen well knowing the said Goods and Chattles to
be the proper Goods and Chattles of the said William and to him of
Right to belong and appertain but contriving and fraudulently
intending craftily and Subtilly to deceive and defraud the said William
in this respect have not as yet delivered the said Goods and Chattles or
any part thereof to the said William although often requested so to
do to wit at London aforesaid in the Parish and Ward aforesaid
but the said Matthew and Stephen to deliver the same or any
part thereof to the said William have hitherto wholly refused [..]
Still do refuse but afterwards to wit on the same day and Year
aforesaid at London aforesaid in the Parish and Ward aforesaid
Convicted and disposed of the said Goods and Chattles to their own
use to the said William his Damage of One thousand Pounds
and thereof he brings [..] his Suit Etc.

Plea

And the said Matthew by Samuel Hoole< no role > his Attorney And the
said Stephen by Joshua Bangs< no role > his Attorney come and Defind
the force and Injury when Etc And say that they are not Guilty of the
Premises above laid to their Charge in manner and form at the said
William Tracey< no role > hath above thereof Complained against them and
of this they put themselves upon the Country And the said William
Tracey doth so likewise Therefore let a Jury thereupon come
before our Lord the King at Westminster on Friday, next after the
Morrow of the Holy Trinity by whom Etc. And who neither Etc. to
recognize Etc because as well Etc the same day is given to the Parties
aforesaid at the same place Etc

At which day before our Lord the King at Westminster the said Parties
come by their said Attorneys and the Sheriffs have not sent back
the said Writ not have they done any thing thereupon Therefore as
before let a Jury thereupon come before our Lord the King at Westminster
on Thursday next after the Morrow of all Souls by whom Etc. and
who neither Etc. to Recognize Etc. because at well Etc. The same day is
given to the said Parties there Etc. At which day before our Lord
the King at Westminster the said Parties come by their said
