maketh Oath and Saith that he was on the fourteenth day of April
last Came by Recognizance before the Right Honourable The Lord Mayor< no role >
for the appearance of himself to prosecute and Samuel Chapman< no role >
his Servant
to give Evidence against Mary Mc Daniel< no role >
for feloniously
stealing from this Deponent five pounds weight of Cheese his
property at the next Session to be held for the City of London
. And
this Deponent further saith that being ignorant of the proper
Steps to be taken in such prosecution he inquired of a Constable who this Deponent was acquainted with
of the Name of Clinton what he ws to do which Constable informed him this Deponent
that he would have notice when to attend, that in consequence
of such Information he this Deponent depended upon having a
Notice when he should attend and did not make any other enquiry
until Friday the thirteenth day of May when he [..] heard by mere
accident that the Session was at that time holding at the Old
Bailey and that he should go and look at the list which hung up in
the Yard for that the Trials would common as they stood in that
List, And this Deponent further saith that he immediately went
to the Old Bailey
and found that the Name of the Prisoner was
not upon the List and therefore this Deponent after waiting
two hours thought he might safely go home to Dinner not
at that time knowing that it was necessary for this Deponent
to take out an Indictment before the Name could appear on such
