but by some Accident part of the Oats were spilt, theOats
said Buckee and Curtis carried off the Oats they had put
into the Sack, and roll'd up the Sack the said Oats were
brought on Shore up and put it under a Seat whereon
the Watermen at St. Catharines Stairs usually sit
And this Informant further saith that the said
Buckee and Curtis took the Oats they had spilt and in Handkerchiefs
broughtcarried the same to the Watchhouse, he this Informants in Company of ye Constable
took the Sack from under the Bench and also carried
the same to the Watch House, which sack he hath is
Informant hath since found belonged to Mr. William
Sherwood

the Sack; and this Informant further saith that the
few Oats spilt being in Quantity about half a
Poushel were by Directions of the Constable of the
Nightcatput into the Sack and carried to the
Constables House and both these Informants further
say that the said Sack and Oats were taken by the
said Buckee and Curtis with Intent to steal the same
as they in their Consciences believe.
