Indicted in London upon Six
Several Indictments for
Compounding Offences in the
Coal Trade against the Form
of the Statute.

Bowman Brown the Defendant in this Cause and Thomas
Warren
< no role > of the Inner Temple London Gentleman jointly and
Severally make Oath and say And first the said Bowman
Brown for himself saith that he hath as Plainliff been
concerned in many Que I am Actions against Sundry People
Dealers in Coals for divers male practices in the Coal Trade
several of whom have by Leave of the Court compounded the same
but they thought much of the high Charges the Attornies mad
for obtaining the Rules for that Purpose Therefore on the Third do
of March One thousand seven hundred and Sixty Six he this
Deponent look an opinion to know if such Mathew before Action
brought could not be agreed without applying to the Court for Leave
and thereby was informed they might which said Opinion is as
followeth to wit Case Whither A can make it up with
B. upon a penal statute as no Action is brought against B.
Whither A can be safe in so doingI am of opinion A. [..]
on what Terms he pleases agree to bring no Action against B.
as none is already brought, but I Conceive such Agreement will
not hinder any other person afterwards from bringing an Action
for the same OffenceThos. Warren 3d. March 1766 Inner Temple
This Deponent further Saith that afterwards and not before it was
that the Prosecutors of the Six Several Indictment above mentioned
to wit John Booth< no role > Thomas Burton< no role > Joseph Harrison< no role > Stephen midwood< no role >
Thomas Kendall< no role > and Thomas Chapman< no role > Severally made Applications
to this Deponent to make an Agreement with them no to bring action
against them for Offence they had been defected in as by the
Indictments themselves will more fully appear and to which he
this Deponent begs Leave to refer This Deponent further Saith that it
was in pursuance of the said Opinion that he agreed the said Matters
with there firmly believing that from the said Opinion he had a
Right so to do and doth on his Oath say that he so consider in the
said Opinion that at the Time of making the said Agreements he did
not apprehend he was in any manner offending or Committing any
Offence whatsoever against the Laws or against the said Act of
Parliament And the said Thomas Warden< no role > for himself saith that they
