Constables
upon the Keys, Maketh oath and saith That he this
Deponent on the Second Day of May Sessions attended at Justice Hall
in the Old Bailey
to Prosecute and give Evidence against the said
William Tinkler< no role >
for the said Felony, and this Deponent did
attend at the said Old Bailey
, before the Sitting of the Court, for
that Purpose, and finding the said William Tinkler< no role >
stood, the
Eighth Person upon the List this Deponent thought he had Sufficient
time to go and Eat his Breakfast in the Neighbourhood, and was
Casually but not Designed absent from the Court about a Quarter
of an Hour, in which time the said William Tinkler< no role >
was Discharged
by Proclamation for want of this Deponents appearing to Prosecute
him for the said Felony
And Lastly this Deponent Saith That he had no Design
whatsoever that the said William Tinkler< no role >
should have Escaped
Justice on this Tryal for want of this Deponents Evidence against
him For this Deponent Positively saith that he did intend to
have Given his Evidence against him, and did attend on purpose
with Design so to do and that his Absence at the time of such
Tryal, was merely accidentally and no ways Designedly as
above sett forth.
