Nicholls never in no Conbination (meaning Combination) nor consprising (meaning conspiring) against any Person
that Week I Sollomnly (meaning Solemnly) declare She never was out of my Company (meaning Company) the
Washing was begune before I came & the Cloves (meaning Cloaths) was not all got out of the Way till ye Saturday Night
We never was abroad but One day in that Week it was one (meaning on) ye Fryday Jnevor was out of her Company
(meaning Company) All that day It was about Eight o'Clock at Night when We came home to Supper to ye best of my
knowledge What We had that Night was low (meaning low) fowles rested

The Indictment further averrs that sd. Mary was not in Company with Deft on sd. 9th. day of Nov. And could
never Swear the Matters contained in sd. Paper Writing according to Truth & yt at sd. time when Deft So Sent ye Same
Deft knew that sd. Mary could not Swear Etc ye Matters contained therein To the Great hinderance of Justice To
ye Evil Example Etc & agt. ye Peace Etc

Deft was arraiggned at ye old Baily & Pleaded Not Guilty

The Case

1739


One William Frankland< no role > a Prisoner in Newgate for Debt having been very Zealous in promoting a
Complaint to ye Court of Aldren of Sevl. Exactions & Male Practises of ye head Turnkey Nicholls or rather of ye
Deft his Wife & ye Court of Aldren having Sett on feet on Enquiry into those Abuses the Deft thought it proper to
remove Frankland out of ye Way & therefore contrived to have him charged with a Robbery committed in Oxfordshire in Order
yt She might remove him thither by Haes Cor.

For this Purpose she gott Edward Bygrave< no role > one of her Creatures to go with her to Mr. Justice Morris at
Kensington Where being both disguised and personating Mr. Spacer of Aynor in Northamptonshire & his
Sister both Swore the Robbery) By grave's Informacon alone being taking in Writing) and obtained a Warrt
agt. Frankland And Deft Afterwards made Several Attempt to gett a Habe as Corpus but and
not obtian it and at last was totally prevented by a Discovery being made of ye Conspiracy to ye Court of
Aldermen

The Court having ordd. a Prosecucon Bygrave was taken but ye Deft Nicholls made her Escape to France
Bygrave was Indicted for Perjury, pleaded Guilty and dyed Soon after his Sentence

The Deft having privately returned was by means of her Husband discovd. & charged with this Conspiracy
and in I an Sessions 1741 a Bill of Indictmt. was found agt. her to which She pleaded Not Guilty
Having contracted an Intimacy with One Mrs. Knible a Relacon of her husbands and having found Means
to Persuade her of her Innocense She prevailed upon her in this her Distress not only to land her All
ye Money She had or could borrow but to give her Notes of hand for Consble Sums and to land and pawn
for her all most All her Cloaths Turniture and Effects to ye Great Prejudice of not only of herself but of a
Mother and two Sisters Who subsisted upon a Small Pension yt had as a Lieuton of a Man of
Warrs Widow

Besides All Which She had likewise persuaded Mrs. Knibls to offer herself for one of her Bail and
accordingly 10th. Feb 1741 Mrs. Knible went up with her to Westminster but was rejected by ye Court & Mrs
Nicholls remanded to Newgate

In their Return from Westm Mrs. Nicholls bid Mrs. Knible Send her Mother Mrs. Mary Tannatt< no role > to her
as soon as she got home for yt. She had Something of Consequence to say to her

Mrs. Kniblo Who had begun to ask Mrs. Nicholls for some of her Money & things back again was in hopes
yt. She wanted to talk with her Mother on yt. Subject and therefore Joy fully goes home tells her
Mother wt. Nicholls had desired and hurries her away.

Mrs. Tannatt Imediately Sent out for a Neighbour Mrs. Catherine Merchant< no role > for to go with her & they
went Imediately together

As soon as they latred Nicholls's Aparmt. in Newgate She welcomed them in But upon Mrs.
Tannatt telling her yt her Dear & She were almost rained this her Means and yt. She hoped she had
