abovenamed Deft. maketh oath That Moses netherwood< no role >
of the Rose Inn
in West Smithfield
London Inholder
and
Samuel Walding< no role >
at the Sign of the Cock
and Crown
in Aldersgate
Street London Victualler
are
two Material witness for this deponent
in this Cause and Says that the said Moses Netherwood< no role >
as out a fortnight age went out of London to Nothingham
and other places unknown to this dept. and hath not
returned since and this Dept further says that the said
Samuel Walding< no role >
hath been near a fortnight
from London
in the County and this Deponent say
that on Saturday last he went to the said Walding
house and inquired of his Wife there whree [..]
said Walding was when she informed this Deponent
that the last letter she had from him was from
Birmingham
where he then was and this Depont.
Says that the said Moses Netherwood< no role >
and Samuel
Walding are Material witnesses for this
dept. att the tryal of the Indictment in this Cause
as he is advised and verily believes and That
without their or one of their Testimony he
cannot Safely proceed to the Tryal of the sd.
Indicmt. in this Cause and further Says that
they are not expected to return to London
untill the begining of next week
