or an Indictment for Perjury

John Wigley< no role > the Prosecutor in this Cause maketh Oath that
the Deft having given Notice last February Sessions for trying
this Indictment he the Same Sessions obtained an Order for
putting of the tryall to the next Sessions addal the next
Sessions the Deft. gave notice of Tryall but did not
Surrender in lane and thereupon the Court was pleased to
order his Recognizance to be estreated But on his
application afterwards the Court was pleased to respit his
Recognizance untill this present Sessions upon his
payment of Capt But the Defend never drew up the Said
Order he had to obtained but the Same was draw up
at this Depts. expence & on this Depts. Sollicitation the
Costs were taxes but the Deft. did not pay the Said Costs
untill this Morning as this Dept. was coming to Court altho this dept hath caused he Same to be demanded
of the Deft. and this Dept Saith that he hath been
putt to more than ordinary expence & trouble in the
prosecution of this matter occationed by the Defts delays
he this Dept. having from time to time attended with eighteen
witnesses necessary as this Dept is informed & beleives
for the tryall of this Cause One of which Witnesses is a
Gentlewoman who this Dept at Great expence brought
from Bath and the being [..] eldy & unfitt for travelling
lie this Dept hath Dept her in town ever Since February
Sessions for the purpose of her Evidence in this Cause And
this Dept. Saith that the Deft. gave notice of motion this Sessions to put of this tryall and this Dept
attended with his Councell [..] to oppose the Sd Motion [..] the said Motion was not made nor a
Countermand given untill after time appointed was over
