of Peter Hawkins< no role >
The said Deft. Mark Halpen maketh oath that an Indictment
for an Supposed Assault being found by the Grand Jury of London
against this Dept on the Prosecution of the said Peter Hawkins< no role >
he this Dept. at the last Sessions of Peace and Goal Delivery held
for the City of London
at Justice hall at the old Bayly Came
Voluntarily into Court and pleaded to the said Indictment not
Guilty and Traversed and Gave Bail to try the aid Indictment
this Sessions and in Pursuance thereof he this Dept Caused notice
in Writing to be given to the said Prosecutor that he would this
day appear and try the said Traverse at the Sitting of this
Court or so soon after as this Court Should appoint and
Accordingly he this Dept. feed Councell and Caused his Witnesses
to be Subpoenaed who attended with this Dept. this day Pursuant
to said Noice in order to have Tryed the said Traverse if this
dayDept. Could have brought the same on But whilst this Dept.
was so Attending this honoble Court the said Prosecutor brought
the Tipstaff
of the Court of Exchequer
and ordered him to take
this Dept. into Custody at the sd. Prosecutors Suit which the
said Tipstaff
did Accordingly and Still Keeps this Dept in
Custody
though he the said Hawkins knew this Dept attended
for the Purposes aforesd.
