The Defendant Edward Griffiths< no role > and John Price< no role > of
Fleet Lane London Gentleman severally make Oath and
say and first this Deponent Edward Griffiths< no role > for himself Saith
That being Indicted in last Tanceary Sessions he this Deponent Prepared
himself with a Brief and Sup [..] James Leake< no role > and John Hughes< no role >
his Two Witnesses to give their Testimony in his behalf and was in every
respect ready to receive his Trial last SessionsThis Deponent Saith that
by some means or other the Prosecutor caused this Deponents Fine to
be put of the last Sessions This Deponent Saith that the
Atendance of his Friends and Witnesses that Session put this Deponent
to a considerable Expence This Deponent saith that on the twenty Second
day of AprilAprilJustice he sent the above named John Price< no role > to
desire the Attendance of his Witnesses this Sessions in this Hanourable
Court and was informed by the said John Price< no role > that they
the said Leake and Hughes went to the City of Dublin in the Kingdom of
Ireland about three Weeks ago which this Deponent believes to be true
for this reason he this Deponent sent his Wife on Tuesday the Twenty
fifth Instant to enquire after them and was informed by her that they were
not returnedThe Deponent John Price< no role > for himself saith that
he being sent by the Deponent Girffiths on the twenty Second Instt. made
strict search and dillgent Enquiry to find out the said James Leake< no role > and
John Hughes< no role > in order to desire their Attendance this Sessions in this Honourable Court
and was informed that about three weeks ago they went about some Particular
Business to the City of Dubbin in the Kingdom of Ireland and were expected
home in a few days This Deponent Edward Griffiths< no role > saith That as the said
Leake and Hyghes are not yet returned without whose testimony he cannot
with any Kind of safety go to Trial this Session He this Deponent begs
for the Reasons aforesaid that Your Lordship Will be pleased to part off
his Trial untill the next when he hopes to be Sufficiently prepared to
make that Defence which become are honest young Man as he most
