for the purpose of Giving the above named Defendant
liberty to take his Trial on the said [..] Fourteenth
day of December instant [..] desired the Application
of this Deponent for alledging that the Defendant not
being in Custody every Person in Custody must be
Tried first Where upon this Deponent informed the said
Defendant and the Prosecutor and [..] their Friends
and Witnesses that he would take Care and let them
know when their Attendance would again be
necessary And this Deponent Saith that on Thursday
and Friday last he Enquired of Mr Shellon the Deputy
Clerk of the A [..] igns when he thought the Sessions
would End [..] this Deponent [..]
Information to have Got the Deffondant to take his
Trial and to have Given the Prosecutor Notice thereof
Pre [..] thereto And Saith that from the Information
he then received of the said Mr Shaltor this Deponent
understood that this day [..] or Tuesday would be the
[..] And this Deponent Saith that he did on
Saturday last Attend [..] at this Court to Watch
if it was necessary to Give the above Defendant
Notice to take his Trial when to his Great Surprize
he was informed that the Jury for Middlesex was
discharged And that therefore the above Defendant
could not take his Trial And this Deponent [..]
