Frances Baker< no role > of wapping in the County of Middlesex Widow and
Philip Lithby< no role > of the Same place Broker Severally make Oath and [..]
[..] Deponent were bound by a Recognizance to prosecute [..]
Bradley at the last Session of Gaol Delivery of Newgate holden for the
County of Middlesex on the Tenth day of April last, and that in Consequence
thereof they these Deponents both attended at Hicks Hall on Monday the
Eighth day of the said Month of April and did then and there prefer [..]
Bill of Indictment against the said Ann Bradley< no role > for the said Felony And that
after these Deponents had been Examined by the Grand Jury at Hicks Hall
they went home And that on the next day being Tuesday the Ninth day
of April last they these Deponents went again to Hicks Hall to know
if the said Indictment was found or not, that when they came there Mr.
who is Crier of the Court at Hicks Hall called to this Deponent
Philip Lithby< no role > by his Name and Sayed" You may go home; your Bill is thrown out"
or Words to that or the like Effect, and that these Defendants believing the
Information of the said Mr.to be true omitted attending
at the old Bailey on the Tryal of the said Ann Bradley< no role > by which Means she was
acquitted for want of Evidence and the Recognizance of these Deponents was
thereupon Ordered to be Estreated And these Deponents Severally Say that the
Reason of their not attending at Justice Hall to give Evidence against the said
Ann Bradley< no role > was Intirely owing to the above Information which they
Received from the Crier of the Court at Hicks Hall and not from any
Wilful neglet or Design in these Deponents that the said Ann Bradley< no role > should
Escape Justice.
