John Hamilton< no role > for Felony

Thomas Hatton< no role > of the Parish of Saint Martin in the
Fields in the County of Middlesex Pawnbroker Maketh Oath and Saith
That on the Eleventh Day of April last he was bound by Recognizance
before John Lane Esquire one of his Majesty's Justices of the peace for the
said County of Middlesex in the penalty of Forty Pounds Upon condition
that he this Deponent should appear at the them next Session of Goal
Delivery to be held for the said County and give Evidence against John
Hamilton
< no role > for Feloniously Stealing one Silk Gown and divers other Goods
the property of Hellen Smith And this Deponent Saith he appointed the
said Hellen Smith the Prosecutrix to call at this Deponent on Tuesday
Morning the Twenty Eighth Day of the said Month of April in Order to go
with this Deponent to Hicks Hall in Saint John Street to prefer a Bill of
Indictment against the said John Hamilton< no role > for the Felony aforesaid but
the said Hellen Smith Neglecting to call on this Deponent at the time
Appointed, This Deponent did go to the said Hellen Smith who then lived
as Servant to one Doctor Brisbane in Titchfield Street in the parish of
Saint Mary le Bone and saw her there who then promised this Deponent
to call on him the next Morning being Wednesday but the said Hellen
Smith Neglecting to call on this Deponent as she had before promised
This Deponent then again went to the said Doctor Brisbane's in Titchfield
Street where she then was Servant as aforesaid and on his Deponents
knocking at the Door the said Prosecutrix opened it and immediately
ran backwards upon which her said Master Doctor Brisbane came to the
Door and greatly Insulted this Deponent and told him this Deponent in a
very abusive manner that he this Deponent might do as he would for
that the said Hellen Smith should not go with this Deponent to
prosecute the said John Hamilton< no role > and this Deponent being Apprehensive
from the illtreatmt. which he had before received from the said Prosecutrix
and her said Master and by their behaviour seemed much inclined to
smother the prosecution against the said Prisoner John Hamilton< no role > and that
the said Prosecutrix and her said Master would carry on the said prosecution
behinds this Deponent back in order that the said Prisoner John Hamilton< no role >
might get Discharged form the said Prosecution this Deponent thereupon
immediatly went to Hicks Hall and stayed there all the said Wednesday
afternoon and all the next Day being Thursday and not seeing or hearing
any thing from the said Prosecutrix or her said Master this Deponent
became very Uneasy thereat being Ignorant and not knowing what to do
he thereupon immediatly applied to the Rotation office in Litchfield
Street and was there informed that this Deponent should go to Hicks Hall
and prefer a Bill of Indictment against the said prisoner John Hamilton< no role >
without the prosecutrix in order to get himself Discharged from his
Recognizance and this Deponent did accordingly on the next Day
