Middlesex The Kingt. Jenkins and Bunce for Felony

Susan Batty< no role > of Saint Mary Newington in the County of Middlesex
Spinster Maketh Oath and Saith That she this Deponent was on the fourth
day of July last bound by Recognizance before Sir John Fielding< no role >
Knight to Prosecute Thomas Jenkins< no role > and James Bunce< no role > for Felony
and this Deponent Saith that at the time she was so bound by Recognizance
the Clerk to the said Sir John Fielding< no role > Informed this Deponent that she
must Attend at Hicks Hall for the purpose of Prosecuting the said
Prisoners on the Monday then next and this Deponent Saith That on the
Monday then next she this Deponent was Extreamly Ill which rendered
her utterly Unable to Attend And Further this Deponent Saith That not
being able to Attend on the said Monday as aforesaid and being entirely
Ignorant of the nature of such Prosecution and could not Afford to Employ
any Person in the Law for that purpose Apprehended that As the said
Monday had Elaps'd that it was then to late to attend on any other Day
to Prosecute the said Prisoners and therefore neglected so to do And this
Deponent positively Saith that such Neglect of prosecuting the said
Prisoners pursuant to the Condition of the said Recognizance was
not by or through any favour or Affection toward the said Prisoners a
either of them or by means of any Profitt Gain or Reward or of the
promise or hope thereof but that the Sole reason of this Deponents neglecting
to Attend to Prosecute the said Prisoners on the said Monday then
next was Entirely owing to this Deponents being Unable to Attend through
Illness as aforesaid and that the cause of this Deponents not Attending
on any other day of the said Session for the said purpose was Entirely
owing to this Deponents Ignorance who Apprehended that no other Day but
the said Monday would do for that purpose and for no other reason or
Motive whatsoever but this Deponent Saith That if she had thought
or known that if any other day after the said Monday would have done
for this Deponent to Attend she this Deponent would have duly Attended
to Prosecute the said Prisoners pursuant to the condition of the said
Recognizance.
