Jacob Lawrence< no role > of the Parish of Saint Pancras in the County of Middlesex
Pawnbroker and Mary Jones< no role > Servant to the said Jacob Lawrence< no role > severally
make Oath and say and first the said Jacob Lawrence< no role > saith that he did on
Friday in the last Oct. Sessions Week at Hicks Hall get an Indictment found
against Elizabeth Eyres< no role > for Stealing one thirty six Shilling Piece then
Property of this Deponent and his Brother John Lawrence< no role > , and about twelve
O'Clock at noon of the same Friday this Deponent was ordered to go from
Hicks Hall to the Old Bailey with his Witnesses to give Evidence against
the said Elizabeth Eyres< no role > , for such Theft, and this Deponent further
saith that his Wife being dangerously Ill, he did before he went to the
Old Bailey , go home with all the Expedition he was able, to see how his
Wife was, and from thence went to the Old Bailey , and got there about
half an hour after two O'Clock in the afternoon of the same Day, when
to this Deponents great Surprize he heard that the said Defendant
had been tried, and acquitted for Want of Prosecution, and his
Recognizance ordered to be Estreated into the Exchequer for not
Prosecuting her, And this Deponent further saith that he was fully
determined to prosecute the said Elizabeth Eyres< no role > for the said Theft and
that it was not out of any favour or for Gain or otherwise that made
him go home, only as before stated, And if this Deponent had thought
the Tryal of the said Elizabeth Eyres< no role > would have came on so soon he
possitively saith that nothing should have hindred him from giving
Evidence against her, as by his Recognizance he was bound to do, And this
Deponent humbly hopes that this Honourable Court will for the Sake of his
Family order his Recognizance to be discharged, And this Deponent Mary
Jones
< no role > Saith that she did attend at Hicks Hall as a Witness against the said
Defendant, and that on said Friday about twelve O'Clock at Noon, this Deponent
understood the Indictment was found a true Bill, and that thereupon this
Deponent understood she was to go to the Old Bailey to give Evidence there
against the said Defendant, That this Deponents Mistress being at that
time being dangerously ill, her Master the said Jacob Lawrence< no role > left this
Deponent at anpublicacquaintances House while he went home to see how her Mistress
was, as he informed this Deponent and which she believes to be true and
told this Deponent he would call for her when he came back, that her said
Master did come to her again, and they went together to the Old Bailey in
Order to give Evidence against the said Deponant, and get there about
