318. PETER WARREN FITZER proceedingsdefend was indicted for stealing, on the 28th January , one firkin, value 9s. , the goods of John Truman Villebois proceedingsvictim , Henry Villebois proceedingsvictim , Sampson Hambury proceedingsvictim , Thomas Fowell Buxton proceedingsvictim , Thomas Butts Aveling proceedingsvictim , Thomas Malborough Poujon proceedingsvictim , and Robert Pryor proceedingsvictim .

HENRY PORTER. I am drayman to Messrs. Truman and Co. On the 28th of January, I was at the corner of Crispin-street, Spitalfields , with my dray, between six and seven o'clock in the evening, and missed a cask. I saw it at Mr. Gullen's in about two hours, with the marks all chipped out. Smallman told me where to find it.

ANN GULLEN. My husband is a cooper. On the 28th of January, two men brought a cask to our house to sell - I told them I would not buy it; they then asked to leave it there for a few minutes. I believe they both asked me to let them leave it.

JOHN SMALLMAN. On the 28th of January, I saw the prisoner with the firkin on his shoulder, in White's-row, Spitalfields; he took it into Gullen's shop. I went in with him, and afterwards told the drayman.

ANN GULLEN < no role > re-examined. What did the man do to the cask in your presence - A. I did not take notice.

Q.Did they not strike the marks out in your presence - A. I do not know - I believe he had a tool in his hand. I do not know the prisoner.

THOMAS GARTON < no role > . I am an officer. When I took the prisoner, Mrs. Gullen said, she held the candle while the prisoner defaced it.

GUILTY Aged 17.
