James Leith< no role > the abovenamed Deft. maketh Oath That
the Honble John Stuart< no role > Esqris: a material witness for this
Depont: on the Tryal of the Traverse of the above Indictmt.
and without whose Testimony this Depont: cannot Safely
Try the Traverse thereof And this Depont. Saith that the
said Mr: Stuart [..] went for Holland in or about
Christmas last past on his Affairs & Business and before
his Departure he the said Mr: Stuart informed this
Depont: that he Could not return to England untill the
Latter End of this present month of July or the
beginning of August next when he should return
hither which Information this Depont. verily believes to
be true And this Depont: further saith that the sd. prosecutor
having in or about the Month of January last comenced
an Action agt: this Depont. in his majesty< no role > 's Court of Kings
Bench for the very same prtended Assault for which
the above Indictment was preferred this Depont: for the
reason aforesaid was obliged to be at the Expence &
Trouble of moving the said Court of Kings Bench both
Easter & Trinity Term last past to putt off the Tryal
of Such Cause which the said Court According did.
