Lawrence Donolley< no role > ye. Dept. in this Cause & Gelesius Macmahan< no role > of ye. Parish of St. Clements Danes in ye. County
of Middlesex Gentleman make oath & say, And First ye. Deponent Lawrence Donolley< no role > for himself saith, yt. at ye.
General Quarter Session of ye. Peace held in October last for ye. City & Liberty of Westminster He this Dept.
was Indicted for an Assault on Cornelius Yorks< no role > ye. Prosecutor in this Cause And in January
Session last held for ye. sd. City & Liberty this Depont. appeared and pleaded not Guilty to ye. sd. Indictmt.
and put in bail to try his Traverse thereon at ye. last Session of ye. Peace held for ye. sd. City and LIberty, which
this Depont. intended to do pursuant to ye. condition of ye. Recognizance Estred into for that purpose. But
this Depont. this applying by affidt. to ye. last mentiond Court, yt. one Ralph Fuller< no role > a material witness
for this Dept. on ye. Trial of ye. sd. Indictmt. was then at Working ye. Kingdom of Ireland , ye. Court on
Reading that affidavit was pleased to Order yt ye sd. Recognizance shod. be Respited until this present
General Quarter Session of ye. Peace, And in order to try ye. sd. Indictmt. of this Present Session, this Depont.
went about a week since to Injure after one John Brasels< no role > who liked as a Servant at ye. Ship and Star
Alehouse in ye. Butcher Row at as Sample Bar to Guild Evidence for this Dept. in this Cause where this
Depont. was informed by Mr. Brion Cavenagh< no role > ye. Master of ye.sd. House & which this Dept. believes to be true
yt. ye sd. John Brasole< no role > was lately gone from his Service to Liverport in Lancashire to work in ye. Cobatte
Trade there and expected to Return from House to London by Michaelmas And this Dept. Further
Saith, yt. ye sd. Ralph Fuller abovementioned is (as he has also been informed & verily believes by a Letter
from him directed to one Mr: Sullivan) still at Cork in ye. sd. Kingdom of Ireland , and exported to Return from that
Place to London, to be Entred as a Student in ye. Law against Michaelmas Term next And lastly this Dept.
saith yt. ye. sd. John Brasele< no role > and Ralph Fuller< no role > are both material Witnesses for this Dept. on ye. Tail of
ye. Indictmt. in this cause and yt. be cannot safely proceed to such Trial without yr. benefit of their testimony
by reason of their being both present at ye. time when ye. sd. pretended Assault is supposed to be comitted And
ye. Dept. Gelesius Macmahath< no role > for time of saith yt. he this Dept. did yesterday serve ye sd. Cornelius Yorks< no role >
by leaving with his wife a notice in Writing, purporting yt ye.Court of Genl. Quarter Session of ye. Peace to
be held for ye. sd. City and Liberty wod. Removed on this day, yt. ye Trial of ye. Indictmt. in this Cause
might be put off.
