Abbott's wishes or words to that and the like effect Deponent then requesting
the said Mr John Hele to come on the premises and point out any thing
this Deponent had done that was wrong and not according to the Acts
and he would immediately cause it to be altered which the said Mr
John Hele promised to do and in a few days he accordingly came and
went into the said premises and Buildings and there in the presence of
Mr Benjamin Charters< no role > he this Deponent very particularly requested
and importuner the said John Hale< no role > to do his duty as a Surveyor of the
district and if there was anything that required altering on the premises
the men should immediately do it but he refused to examine the
Building although he was at that time standing in about the Middx
of it and would not as Surveyor of the District neither approve or
find any fault with any part of it but insisted that until Deponent
agreed to do as Mr Abbott should require concerning the height of the
Building so that his window might be clearly above the whole of the
Building roof he would not as district Surveyor say he approved or
disapproved of the way the Buildings were so far carried on or give
any directions for finishing it And Deponent further saith that in
consequence of this extraordinary behaviour of the said John Hele he
reminded him of his Oath to act impartially in his Duty as Surveyor
in the District in which situation he ought not to interfere between
Mr Abbott and Deponent to which the said John Hele answered the
notices to him had not been made in writing and until he received a
written notice he would not attend as District Surveyor a words to
that or the like effect he this Deponent further saith he then in his own
hand writing made out a Notice and sent the same to the said
John Hsle requiring him to come in and inspect the same Alterations
Works and Erections on the said premises as aforesaid and did deliver
the aforesaid Notice so written to the aforesaid James Mams< no role > with
directions to personally serve the said John Hale therewith and the said
Deponent further saith that the said James Mams afterwards on the
same day informed this Deponent that he had served the said John
Hle with the said Notice as aforesaid and that the said John
Hele had promised to come and inspect the said premises and Building
